	<abstract_fa>&lt;div style=&quot;text-align: justify;&quot;&gt;&lt;span style=&quot;font-size:10pt&quot;&gt;&lt;span style=&quot;direction:rtl&quot;&gt;&lt;span style=&quot;unicode-bidi:embed&quot;&gt;&lt;span style=&quot;font-family:&amp;quot;Times New Romans&amp;quot;,serif&quot;&gt;&lt;span lang=&quot;FA&quot; style=&quot;font-size:12.0pt&quot;&gt;&lt;span style=&quot;font-family:&amp;quot;B Lotus&amp;quot;&quot;&gt;مسئولیت مدنی شرکت&#8204;های فعال در حوزه اصلاح ژنتیک، به&#8204;ویژه در کاربرد فناوری کریسپر (&lt;/span&gt;&lt;/span&gt;CRISPR&lt;span lang=&quot;FA&quot; style=&quot;font-size:12.0pt&quot;&gt;&lt;span style=&quot;font-family:&amp;quot;B Lotus&amp;quot;&quot;&gt;) در زمینه سلول&#8204;های زایا و جنین انسانی، از آن جهت اهمیت دارد که برخی تغییرات ایجادشده در سطح ژنوم ممکن است دارای آثار پایدار بوده و ارزیابی پیامدهای احتمالی آنها نیازمند بررسی&#8204;های دقیق علمی و حقوقی باشد. پژوهش حاضر با روش توصیفی-تحلیلی و بر پایه منابع کتابخانه&#8204;ای، مبانی و ارکان این مسئولیت را از منظر فقه امامیه و حقوق ایران بررسی می&#8204;کند و در پی پاسخ به این پرسش است که آیا قواعد عمومی مسئولیت مدنی ظرفیت پاسخگویی به خسارات احتمالی ناشی از کاربرد این فناوری را دارند. یافته&#8204;ها نشان می&#8204;دهد ویژگی&#8204;های خاص مداخلات ژنتیکی، از جمله پیچیدگی فرایندهای زیستی، امکان بروز آثار در بازه&#8204;های زمانی متفاوت و ضرورت توجه به آثار بالقوه قابل انتقال به نسل&#8204;های آینده، بررسی رابطه سببیت و تعیین حدود مسئولیت را با چالش&#8204;هایی مواجه می&#8204;سازد. در مقابل، قواعد فقهی لاضرر، اتلاف و تسبیب هریک در قلمرو مشخصی ظرفیت تحلیل مسئولیت را دارند و تسبیب می&#8204;تواند در مواردی که شرکت از طریق طراحی نامناسب، نظارت ناکافی یا ارائه اطلاعات ناقص در ایجاد زمینه ورود زیان نقش داشته است، مبنای مناسبی برای بررسی مسئولیت باشد. نوآوری پژوهش در تفکیک قلمرو کاربرد این قواعد و پیشنهاد الگویی چندلایه است که بر اساس آن، مداخلات درمانی در سلول&#8204;های بدنی می&#8204;تواند عمدتاً در چارچوب مسئولیت مبتنی بر تقصیر بررسی شود و در خصوص مداخلات زایا و جنینی، با توجه به ویژگی&#8204;های خاص این حوزه، امکان بهره&#8204;گیری از سازوکارهای تعدیل بار اثبات یا مسئولیت محض مورد توجه قرار گیرد؛ با این تأکید که احراز زیان و رابطه سببیت در هر دو حالت ضروری است. بر این اساس، تدوین مقررات تخصصی و متناسب با ویژگی&#8204;های فناوری&#8204;های نوین ژنتیکی، می&#8204;تواند زمینه استفاده مسئولانه و ایمن&#8204;تر از این فناوری&#8204;ها را فراهم سازد.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;br&gt;

This study, employing a descriptive-analytical method based on library research, examines the foundations and elements of such liability from the perspectives of Imami jurisprudence and Iranian law, seeking to determine whether the general rules of civil liability are capable of addressing potential harms arising from the application of this technology. The findings indicate that the specific characteristics of genetic interventions, including the complexity of biological processes, the possibility of effects emerging over different time periods, and the need to consider potential intergenerational consequences, create challenges in establishing causation and determining the scope of liability. In contrast, the jurisprudential principles of lā ḍarar, itlāf, and tasbīb each provide a basis for analyzing liability within their specific domains. Among them, tasbīb may provide an appropriate basis for examining liability in cases where a company contributes to the creation of harmful conditions through defective design, inadequate supervision, or incomplete disclosure of relevant information. The novelty of this study lies in distinguishing the scope of application of these principles and proposing a multi-layered framework according to which therapeutic interventions in somatic cells may generally be assessed within a fault-based liability framework, while germline and embryonic interventions, considering their specific characteristics, may require mechanisms such as a modified burden of proof or, in limited cases, strict liability. In both situations, however, establishing harm and causation remains necessary. Accordingly, the development of specialized regulations consistent with the characteristics of emerging genetic technologies can contribute to their more responsible and safer application.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;br&gt;
